    Hi All,

    I was sitting at a stop today behind 4 or 5 cars when a guy in an SUV with a trailer hitch backed into me, he said he didn't see me and didn't bother to look through his rear view camera.

    So far the items distroyed and the estimated replacement cost from the RMSCI website came out like this, which the guy said he wanted to pay in cash verse through his insurance company are as follows:

    Nose Cone Green $285.60
    Nose Cone Badge $67.20
    Nose Cone Grill $?????
    Left Cycle Wing Green $92.40
    Headlamp Shell $175.00
    Indicator mounting cone $30.91
    Aluminum Radiator w/fan $539.00
    Radiator mounting hardware $28.00
    Radiator Upper Hose $23.45

    Has anyone else been through this kind of unfortunate situation? and know of something hidden that I may not be seeing?

    I checked my suspension points and made several measurements and all looks normal.... but it doesn't reduce my amount of aggrivation at people that dont pay attention, that and not being able to drive the car on a warm beautiful day like today.

    In my opinion you should notify your insurance company of the incident and should have exchanged insurance information on the spot. You should also file an accident report. I don't know where you live but according to this here California law requires filing a report in the event of an accident where injuries happen or the damage exceeds $750.

    Failure to do so leaves you exposed to loss as the other individual can simply deny that anything ever happened and the burden is on you to pursue them for the dough in small claims court, a time and money waster if ever there was one.

      You forgot the labor cost to r&r, towing, car rental, parts freight/handling, taxes/duties/fees, and the cost of misc. items like coolant, etc.

      By agreeing to accept a cash payment, you are betting that the other party is honest and trustworthy. Why take the risk? At the very least, obtain the other party's insurance information and hold it pending his performance regarding any promises made. File the SR22 with the State. It will not effect the cash deal and gives you credibility if things go "sideways" down the line.

          I was thinking about the very thing of filing the SR22 form, I have all of the other drivers informaton.... Name, Address, Phone Number, Insurance Information, Place of employment, Cal Drivers License Number and License Plate....

          He seems straight up and very apologetic, and appears to want to pay for the damages in cash so his insurance rates dont go up.

          I spoke with the guy this evening and told him the cost of replacement parts was going to be about $1,400 with shipping.... know I need to call RMSCI and see if they have the parts.

          Figure if he doesnt hold up to his end I will let my attorney go after him for the cost of repairs, which will be a lot higher if the attorney pursues the matter.

          Yeah, those darn SUV's.... but to be honest, 99% of the people I pass on the road are good drivers, but it only takes one.

            file the police report. if he flakes u and ur attorney are then at a huge disadvantage in trying claim restitution because u broe the law in not filing the accident report if similar law exists in Cali.

            and definitely total labor and anything else to bring the 7 back to spec before the accident.

            in all honesty, if he was begging me to keep it off his insurance which is another sketchy situation i'd be hesitant.

            but i think maybe the black pack is order and possible the 3pass radiator.
            u are in aposition i don't envy. good luck with how everything resolves itself.
